1.   CHECK-IN TIME IS AFTER 2PM  AND CHECK-OUT IS BY 10AM  NO Early Check-in or late check-out.

2.   This is a NON SMOKING unit.

3.   DOG POLICY- Dogs are permitted in Cottage only with prior approval. A non-refundable dog fee applies, please refer to your confirmation letter. All dogs must be leashed at all times unless within the Cottage or fenced yard. Dog owners are responsible for cleaning up any/all pet refuse by collecting it in plastic bags and putting the plastic bags in the street side trash receptacles. All dogs must be up to date on rabies vaccinations and all other vaccinations.  Heartworm preventive is highly recommended. All pets are to be treated with Advantage or similar topical flea and tick repellent three (3) days prior to arrival, unless on a continuous monthly treatment schedule, then the normal monthly application is acceptable. Fleas and ticks can cause harmful/fatal illness to humans and dogs. All items above are the sole responsibility of the dog owner. The property owners assume no responsibility for illness or injury that may occur to dogs or humans while on the premises. 

4.  SECURITY DEPOSIT- A security deposit is required (see confirmation for amount). This must be received within seven (7) days of booking the reservation. The security deposit is NOT applied toward rent.  The purpose of the security deposit is to protect the Cottage and contents from malicious and negligent damages or from being left abnormally dirty, (i.e. carpet and/or furniture stains, missing items, broken mini-blinds, excessive pet hair, etc.).  Unnecessary service calls may also be deducted from the deposit. The Cottage is inspected after each tenancy.  The security deposit is fully refundable within (14) days of departure, provided the following provisions are met.

a. No damage is done to the Cottage or its contents, beyond normal wear and tear.

b. No charges are incurred due to pets, collection of rents, or services rendered during the stay.

c. All debris, rubbish and discards are placed in trash receptacles and all recyclables are placed in recycling receptacle, both of which are located in the corral next to the street on the ocean side of the driveway.

d. All soiled dishes are placed in the dishwasher and dishwasher is run to clean the dishes. 

e. One key is returned to the lockbox, remaining keys are placed in the key holder in the kitchen, and Cottage is left locked. 

f. NO Early check-in or late check-out (unless pre-approved by Owner).

g. Parking pass is left on hook in kitchen by key holder upon departure.

h. The tenant is not evicted by the owner (or representative of the owner), or the local law enforcement agency.  

i. Cancellations are made in accordance with item 6 below.

j. Excess cleaning is not required – property must be left broom clean and free of excessive dog hair

k. All furniture is returned to its original location

5. PAYMENT – An advance payment equal to 50% of the total of the rental rate + taxes + dog fee + cleaning fee is required within seven (7) days of booking the reservation. The advance payment will be applied toward the rent, taxes and dog fee. Please make payments in the form of a traveler's check, bank money order, cashiers check or personal check payable to: Castles By The Sea, LLC. The advance payment is not a security deposit. THE BALANCE OF RENT, TAXES AND DOG FEE IS DUE THIRTY (30) DAYS BEFORE YOUR ARRIVAL DATE.  NOTE: WE CANNOT ACCEPT A PERSONAL CHECK LESS THAN THIRTY (30) DAYS PRIOR TO ARRIVAL.

6. CANCELLATIONS: A ninety (90) day notice is required for cancellation. Cancellations more than ninety (90) days prior to the arrival date will incur no penalty. Cancellations made within ninety (90) days of the arrival date forfeit the full advance payment and security deposit. Tenant is responsible for full amount stated on confirmation letter, EVEN IF STAY IS SHORTENED (such as late arrival or early departure) unless there is a mandatory evacuation order as stated in item seventeen (17) below. After check-in, cancellation or early departure does not warrant any refund of rent or deposit. You may choose to purchase travel insurance separately. See item number eighteen (18) below.

7. THIS IS A FAMILY RENTAL PROPERTY – No groups are allowed. A family is defined as those residing in the same primary residence and/or those related by blood, marriage or adoption. No more than two (2) persons not defined as family are permitted to occupy the Cottage.

8. MAXIMUM OCCUPANCY- The maximum number of tenants is limited to twelve (12) persons.

9. THIS PROPERTY REQUIRES A SEVEN (7) NIGHT MINIMUM STAY DURING THE SEASON.

10. NO DAILY MAID SERVICE, NO LINENS, SOAP OR PAPER PRODUCTS – Daily maid service, linens (sheets, pillow cases, towels & wash clothes – bath and kitchen), soap and paper products are NOT included in the rental rate.

11. CLEANING: Our goal is to have the Cottage cleaned between 10AM and 2PM on your day of arrival.  Occasionally it will be necessary to clean later than these times. Therefore we reserve the right to clean premises until 6PM on day of check-in.

12. FALSIFIED RESERVATIONS – Any reservation obtained under false pretense will be subject to forfeiture of advance payment, security deposit and/or rental money. The party will not be permitted to check-in or will be evicted.

13. PARKING PASS – A parking pass for parking on the ocean side of the highway is located inside the Cottage. It is only valid in the town of South Bethany, not the town of Bethany Beach (north of the Sea Colony high rises). Renters must display parking pass on the rear view mirror at all times when parking on the ocean side of Route 1 in South Bethany. Failure to display pass may result in towing of vehicle at renter's expense. Leave the parking pass inside the unit on the hook in the kitchen by the key holder upon departure.

14. PARKING – Parking is limited to four (4) vehicles. Vehicles are to be parked in driveway only. Parking on the road is not permitted. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner.

15. RENTERS RESPONSIBILITY - The owners are not responsible for any accidents, injuries or illnesses that occur while tenants or their guests are on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the tenant or their guests. By accepting this reservation, it is agreed that all tenants are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.

16. SEWER - The sewer system is very effective; however, it will clog up if improper material is flushed. DO NOT FLUSH ANYTHING OTHER THAN TOILET PAPER. No feminine products or paper towels should be flushed at anytime. If it is found that feminine products or paper towels have been flushed causing the sewer system to be clogged, you could be charged damages of up to two hundred dollars ($200). Also, the inside shower drains will not operate property if sand is rinsed down them. Use the outside shower to remove sand.

17. HURRICANE OR STORM POLICY – No refunds will be given unless this Cottage is affected by a mandatory evacuation order. The day that a mandatory evacuation order is issued we will refund:

a. Any unused portion of rent from a guest currently registered,

b. Any unused portion of rent from a guest that is scheduled to arrive, and wants to shorten their stay, to come in after the mandatory evacuation order is lifted; and

c. Any advance rents collected or deposited for a reservation that is scheduled to arrive during the mandatory evacuation period.

18. TRAVEL INSURANCE: We highly recommend you purchase travel insurance. If you wish to purchase travel insurance, go to www.InsureMyTrip.com for details and to purchase.

19. EVICTION: The owner (or representative of the owner) at their sole discretion may evict tenant if tenant violates community ordinances or these rules, becomes objectionable to neighbors or creates damages to the leased property. Tenant acknowledges that in this event no refund shall be given even if the property is re-rented.

20. FIREPLACE: The fireplace is a propane gas log fired firebox. Please do not throw any paper or other combustible materials in the fireplace. Fireplaces are turned off from April 15 – October 15; they are not operational during this time of the year.

21. SUBLET: Tenants are not permitted to sublet.

22. EXCESS CLEANING FEE: If Cottage is not left broom clean and free of excessive dog hair, or if furniture is not returned to its original location (see 24 below), tenant may be charged an excess cleaning fee not less than $35.

23. DEFAULT: If tenant gives owner a check, draft, or money order which is not immediately collectible, Owner and or Agent may, without suit, court order, or notice to tenant re-enter and take possession of the Cottage or terminate lease if possession has not occurred. Tenant shall forfeit all monies paid and in addition, shall be liable for such other damages as may be collected by law.

24. MOVING FURNITURE:  If furniture is moved it must be returned to its original location prior to departure.

25. TV, PHONE AND INTERNET SERVICE: These services are provided as a convenience and are not guaranteed. If service is not available all efforts will be made to restore service.

 

I agree that all rental monies are non-refundable per cancellation policy above. I have read my rights to purchase travel insurance. By signing the confirmation paperwork, I agree to all terms and conditions of this agreement.
